Terms of Service

These terms govern your access to and use of the Operator 91 platform and this website. By creating an account or using the service, you agree to them on behalf of your company. If a separate written agreement between your company and Operator 91 exists, that agreement controls where it conflicts with these terms.
1. The service
Operator 91 is a software platform for running the daily operation of a transport company — dispatch, rates, hiring, safety, maintenance, fuel, insurance readiness, and money — with advisory AI features we call Operators. We provide the service on a subscription basis and may add, change, or remove features as the product evolves.
2. Accounts & access
You are responsible for your account, for the users you invite, and for the roles you assign them. Keep credentials secure, use two-factor authentication where the platform requires it, and tell us promptly of any suspected unauthorized access. You must provide accurate information and be authorized to bind your company.
3. Your data
As between you and us, your operational data is yours. You grant us the limited rights needed to host, process, secure, and display it to provide the service, and to create de-identified, aggregated statistics that do not identify you or any individual. Our handling of personal information is described in our Privacy Policy. You can export your core records at any time and request deletion as described there.
4. Acceptable use
Don't use the platform to break the law, infringe others' rights, upload malware, probe or bypass our security, or access data that isn't yours. Don't misrepresent the AI's suggestions as independent professional advice. We may suspend access for conduct that threatens the service or other customers.
5. Operators (advisory AI)
Operators are advisory. They read your data and propose actions into an approval queue; a person on your team decides whether to act. AI suggestions can be wrong or incomplete, and you are responsible for reviewing them before acting. The platform initiates no consequential action — and never moves money — without a human confirming it.
6. Compliance & system-of-record
Read this carefully. Operator 91 helps you organize and act on your operation, but it is not a substitute for your own compliance obligations:
- Not an ELD and not the ELD system of record. The platform does not record hours of service for regulatory purposes. Your ELD provider and your own records remain the system of record for HOS and related FMCSA requirements.
- Driver qualification assists; the carrier is responsible. The platform helps assemble and track driver-qualification files, but you — the carrier — remain responsible for meeting all applicable DOT/FMCSA qualification, drug-and-alcohol, and safety requirements and for the accuracy of your records.
- We never move money. Financial, factoring, fuel-card, and settlement features present and prepare information (including export files); they do not initiate payments, transfers, or payroll. Your financial systems and processes remain authoritative.
- Not legal, tax, safety, or financial advice. The platform's outputs — including rate figures, margin and break-even estimates, and compliance indicators — are informational tools to support your decisions, not professional advice.
7. Third-party connectors
The platform can connect to tools you already use through your own credentials. Your use of those third-party services is governed by your agreements with them. We are not responsible for third-party services, their data, or their availability, and a connector may change if a provider changes its interface.
8. Early access & fees
During early access, some features may be in active development and provided on an evolving basis. Fees, if any, are as agreed in your order or subscription. Except where required by law or expressly agreed, fees are non-refundable.
9. Warranties & disclaimers
We work hard to keep the service reliable, but it is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability arising out of or relating to the service is limited to the amounts you paid us for the service in the twelve months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.
11. Indemnity
You will defend and indemnify Operator 91 against third-party claims arising from your data, your use of the service in violation of these terms or law, or your failure to meet your own compliance obligations.
12. Term & termination
Either party may terminate as set out in your order or, absent one, on reasonable notice. On termination, your right to use the service ends; you may export your data for a reasonable period, after which we may delete it consistent with our Privacy Policy and legal obligations.
13. Changes
We may update these terms as the product and the law change. We will update the date above and, for material changes, provide notice. Continued use after an update means you accept the revised terms.
14. Governing law & contact
These terms are governed by the laws of the United States and the state in which Operator 91 is organized, without regard to conflict-of-laws rules. Questions: [email protected].
